1专利侵权是怎么回事?
和商标版权相比,专利问题是比较复杂的。因为就算我们在上架一款产品前想要排除侵权专利的风险时,大多数情况下也不知如何查起。
专利是针对发明的一种法律保护形式。已公布的专利可授予其所有者禁止他人在固定年限内制造、使用、提供销售、销售或将发明进口至授予专利保护的国家/地区的权利。在美国,专利有两种主要类型:实用新型专利和外观设计专利。
设计专利是针对整个或部分商品的外观,特别是体现商品线条、轮廓、颜色、形状、表面结构和/或材料和/或其装饰的特征的一种法律保护形式。包括包装、图形符号和字体在内的任何工业或手工艺品都可归类为商品。可拆卸和可组装商品的部件也可受到保护。
实用专利也叫发明专利,是最普遍的一种专利类型。与外观设计专利保护产品外观不一样,实用专利更多的是用来保护产品的结构或者某项功能,它有可能是产品某项结构,生产工艺或者改进流程等。
从亚马逊规则来看,专利分为外观专利和发明专利两大类。是否侵权外观专利取决于产品外观的相似度。是否侵权发明专利取决于产品是否应用了同样技术原理的装置。另外,专利保护具有时效性。一项专利过了专利保护期后将不再具有排他性。
2怎样查询具体的专利信息?
通过查看客户店铺相关的侵权邮件,我找到了产品侵权的专利编号:ASIN: B07JBXXXXXInfringement type: patentPatent number: USD517,789Complaint ID:6457312511 我们看到这是注册在美国的专利,所以我们可以登陆美国商标与专利局官网USPTO查询具体的专利信息。也可以用谷歌专利(google patent)查询。输入专利号,很快就找到了专利详情。
很显然,USD517,789属于外观设计专利。
3什么情况下侵权专利可以反诉?
90%的情况下我不接受客户申诉listing的委托,纯属吃力不讨好。为啥?因为绝大多数侵权投诉是事实,没有申诉可供发挥的空间。我们无法颠倒黑白,更不能指鹿为马。
这次破例是因为经过仔细分析,我发现竟然有一定的可能性成功。而且客户是业内大佬,对我展开了猛烈的金钱攻势,我无奈败下阵来。
那么,什么情况下listing侵权专利可以申诉呢?我认为以下2个条件缺一不可:
- 必须是外观设计专利;(发明专利太复杂了,我搞不懂,那是专业律师的饭碗)
- 产品外观与侵犯的专利至少有3大点显著差异;
4申诉信应该怎样写?
很显然,能看懂专利并找出差异便是关键所在。
这是侵权的外观专利详情:
这是客户的产品外观:
乍一看都是洞洞鞋。再一看差异还是很大的。经过分析比对,我认为USD 517,789专利的主要特征点在以下几方面:
1.鞋面网眼形状和分布;
2.侧边镂空形状和分布;
3.鞋带连接方式;
4.前脚掌和后部连接;
5.鞋带网眼形状和分布;
6.鞋底纹路;
然后我看了下客户产品这些关键点的设计,除了鞋型和鞋底纹路几乎一致之外,其他地方均存在明显可见的差异:
1.鞋尖部分没有网眼设计;
2.侧边镂空形状和数量不同;
3.鞋面网眼形状和分布不同;
4.鞋带无镂空设计;
5.鞋跟鞋前脚掌连接处设计不同;
当然,客户这款产品设计有没有参考权利人这款?肯定是有的。但是这只能说借鉴,不能说抄袭。因此有理由说明,并不侵犯权利人的外观设计专利。有了以上5点的显著差异,我认为有一定把握能反诉成功了。于是我快速写了一封申诉信,重点阐述客户产品和专利设计的不同之处,并且配上图片。
申诉原文如下,中文大概意思是“我理解亚马逊对于侵权指控的采取的措施,但是确实不成立。因为产品外观与所涉专利有五大显著差异。它们分别是1,2,3,4,5......”
Hello,Thank you for providing me with the opportunity to appeal my listing removal due to a design right complaint.I understand that Amazon takes complaints about violations of Intellectual Property rights very seriously and I would like to share with you my Plan of Action in which explain what I have done to prove I am not infringing on any intellectual property rights and what I will do to prevent similar complaints in the future.
– Why do I think the design patent infringement complaint is invalid?
It is necessary to state the policy warning received on March 5th before the explanation.ASIN: B07JBXXXXXInfringement type:patentPatent number:USD 517,789Complaint ID:6457312511 I have checked the patent detail on USPTO, and realized it is a design right of a summer shoes. You can check the details from the USD517789 attached.
Here is the productwe sell (ASIN: B07JBXXXXX), and I think it is unreasonable to be complained. Thereare at least 5 significant differences between the product (ASIN: B07JBXXXXX)and the design patent (USD 517,789)1. The top part of the shoe does not have a hollow design;2. The shape and quantity of hollowing on the side of the shoes are different;3. The shape and quantity of hollowing on the top of the shoes are different;4. There is no hollowing on the shoelace;5. The connection between the heel and the front part of the shoes is different; – What have we done after received the complaints?
* I have contacted the rights owner xxxxx to let her know that their company has mistakenly reported my listing and I have asked them to send a retraction notice to Amazon as soon as possible.
* I have carefully reviewed my entire Amazon account and inventory to make sure that my listings are fully compliant with the Amazon policies and guidelines, especially the ones regarding intellectual property and design rights.
- What’s more,in the future:
* Before listing any new products for sale on Amazon, I will verify that the products or listings do not violate anyone’s intellectual property or design right.
* I will regularly read and re-read the Amazon guidelines and policies to make sure that I am not in violation of any of the rules. Also, I will monitorall changes of the policies or any applicable laws, which could affect me or myaccount and react proactively. We never have the intention to infringe on the design patent of others. We did a lot of research before listing the product and found no evidence of patent applications on similar shoes. What’s more, our supplier designed and sold this product since 2018. It is really hard to say we infringed the design patent of others. We cherish the opportunity of selling on Amazon very much and the listing of ASINB07JBXXXXX really means a lot to us. Please investigate this matter carefully and reinstate our sales of ASIN B07JBXXXXX.

Many thanks,Landy 这封申诉信虽然字数不多,但是简单直接。审核团队是不可能花很多时间来阅读的,如果是反诉,就应该直接摆证据讲事实。逻辑严密,无可辩驳,成功的可能性就很大了。
功夫不负有心人。两天之后,我收到了来自亚马逊的解封邮件,告知可以继续销售该款鞋子。
事情结束了吗?不一定。
如果权利人继续投诉,还是有可能会下架。即使再次申诉成功,无疑会浪费时间,且对listing排名造成很大的负面影响。
因此,我把申诉信和亚马逊的回复转发给了权利人,并且诚恳地告知其投诉不合理。大概过了一周时间收到了权利人回复,承诺不再投诉。 又是一个happy ending。真好!希望对各位有所启发。
